Corporate Counsel - Litigation serves as in-house legal counsel supporting the business on a variety of legal matters. Counsel will be responsible for working with our corporate and field leaders to manage and find creative resolutions to claims, disputes and litigation involving the Company, and facilitate the Company’s business and relationships in compliance with legal and contractual requirements. The role may also include involvement in contract review and drafting and compliance matters. The position is based in New Braunfels, Texas and will report directly to Rush Enterprises’ General Counsel.

Responsibilities:

  • Litigation - Claims Management:
    • Work with and manage outside counsel in dispute resolution initiatives and litigation management.
    • Assist in representing Company in litigation, arbitration, mediation, or other dispute forums.
    • Develop legal strategy and analysis regarding the prosecution and defense of lawsuits.
    • Work with insurers, claims representatives, and adjusters and advise on risk management.
    • Work with Company personnel to respond to and find creative resolutions to customer and other commercial disputes and claims
    • Oversee and coordinate accident and fire investigations.

  • General Corporate:
    • Counsel business leaders on risk and negotiation strategy
    • Provide advice on compliance with contractual responsibilities, company policies, and applicable laws/regulations
    • Review and advise on a range of commercial agreements, including truck sales, leasing, vendor, and service agreements
    • Maintain a current understanding of laws, regulations, and industry guidance that impact the Company, including data privacy and consumer protection laws
    • Assist with M&A and other special projects

Basic Qualifications and Attributes:

  • 7-14 years of experience as practicing litigation attorney; in-house experience preferred
  • JD from an accredited law school and admission to a state bar (preferably Texas)
  • Excellent negotiation and organizational skills
  • Experience with litigation, claims handling and dispute resolution including strategy and evaluation
  • Familiarity with personal injury and commercial litigation including deceptive trade practices
  • Strong interpersonal and presentation skills, along with the ability to communicate effectively with others at all levels of the organization.
  • Ability to work well both as part of a team and independently
  • Ability to establish and maintain strong relationships within the organization’s legal department and across all businesses.
  • Familiarity with privacy laws (CCPA, VCDPA, GDPR etc) and/or with corporate sustainability concepts and environmental reporting standards is a plus

USD $160,000.00/Yr.
Maximum Pay Rate

USD $195,000.00/Yr.
